SiteBrief Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Bozarth Software LLC, a California limited liability company (“Bozarth Software,” “we,” “us,” or “our”), concerning your access to and use of SiteBrief, our websites, reports, accounts, and related services (collectively, the “Service”).

By creating an account, purchasing or using the Service, or selecting an acceptance control presented with these Terms, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and authority

You must be at least 18 years old and legally able to enter into this agreement. If you use the Service for a company or another organization, you represent that you have authority to bind that organization, and “you” includes that organization.

2. Accounts

You must provide accurate account information, keep your login credentials confidential, and promptly notify us at [email protected] if you suspect unauthorized account use. You are responsible for activity conducted through your account unless applicable law provides otherwise.

Accounts are personal to the verified user and may not be sold, transferred, or shared in a way that defeats account, payment, or usage limits.

3. What SiteBrief does

SiteBrief retrieves limited, publicly accessible information from a submitted website address and produces a plain-English website-readiness report. A report may contain recorded observations, limitations, and up to five findings selected by deterministic rules as the items most worth addressing first.

A report is a point-in-time, limited review. SiteBrief may observe lower-priority items that are not listed. A later scan is a fresh evaluation: resolved findings may disappear, priorities may change, and another item may enter the first five. Fixing the listed findings does not mean that no other issue exists.

SiteBrief does not crawl an entire website, sign in to private areas, submit forms, execute page JavaScript, perform penetration testing, or actively exploit a website. The checks and limits may change as the Service develops.

4. Permission to evaluate a website

You may submit a website only if you own it, manage it, or have permission from an authorized owner or manager to evaluate it. Before each real scan, you must confirm: “I confirm that I own, manage, or have permission to evaluate this website.”

You represent that this confirmation is truthful. You may not use SiteBrief to probe websites without authorization, evade technical restrictions, interfere with any system, collect confidential information, or violate another person’s rights or applicable law.

We may refuse or block submitted addresses for security, safety, legal, operational, or abuse-prevention reasons.

5. Reports are informational—not professional advice or certification

SiteBrief reports are informational tools only. They are not legal, accounting, tax, cybersecurity, accessibility, engineering, or search-engine-optimization advice. A report is not:

  • a security, accessibility, privacy, or compliance certification;
  • a guarantee of search ranking, traffic, revenue, uptime, or performance;
  • proof that a website complies with any law, regulation, contract, or technical standard;
  • a substitute for a qualified professional’s review; or
  • a representation that SiteBrief found every issue.

You remain responsible for evaluating findings, making changes, testing your website, and obtaining professional advice when appropriate.

6. Current launch offer and payment

At launch, SiteBrief’s paid offer is the SiteBrief Fix & Recheck Pack: $19 USD, one-time, for one website, including three real scans that may be used within 90 days of purchase. It does not automatically renew and is not a subscription.

The checkout page will state the price, currency, included access, website scope, usage period, and material restrictions before payment. Those checkout terms are incorporated into these Terms. Future offers or prices may differ, but a future change does not retroactively alter an earlier completed purchase.

You authorize us and our payment processor to charge the payment method you provide for the selected purchase and any taxes we are required to collect. We do not receive or store full payment-card numbers.

Our Refund Policy applies to purchases.

7. Complimentary and promotional access

We may give an owner, employee, evaluator, beta participant, prospective customer, or other approved user complimentary or promotional access. Complimentary access does not require payment unless expressly stated; may have separate usage limits or an expiration date; is personal to the approved account; has no cash value and cannot be resold or transferred; and may be changed or revoked at any time, subject to applicable law.

Complimentary access does not weaken website-authorization requirements, security controls, technical limits, or these Terms. Completed reports remain subject to our retention and deletion practices.

8. Acceptable use

You may not:

  • submit a website you are not authorized to evaluate;
  • use the Service to attack, disrupt, overload, scrape, reverse engineer, or bypass another system;
  • submit credentials, private URLs, access tokens, or other secrets;
  • attempt to defeat rate limits, payment controls, access entitlements, or security protections;
  • use automated means to access the Service except through interfaces we expressly provide;
  • resell or white-label the Service without written permission;
  • reproduce or distribute reports in a misleading manner or remove required limitations and notices;
  • use the Service for unlawful, fraudulent, deceptive, harassing, or rights-infringing activity; or
  • introduce malware or harmful code.

We may investigate suspected misuse and suspend or terminate access when reasonably necessary to protect users, third parties, or the Service.

9. Your information and license to operate the Service

You retain your rights in information you submit. You grant us a limited, nonexclusive license to receive, normalize, retrieve, process, store, display, and transmit submitted information as reasonably necessary to provide, secure, maintain, support, and improve the Service.

We may use operational records and aggregated or de-identified information to understand reliability, prevent abuse, improve checks and report presentation, and operate our business. We do not sell personal information or use customer scan data for cross-site behavioral advertising. Additional details appear in our Privacy Policy.

10. Intellectual property

The Service, including its software, design, report structure, rules, text, trademarks, and other materials supplied by us, is owned by Bozarth Software or its licensors and is protected by applicable law. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable right to use the Service and your reports for your own internal business purposes.

Feedback is voluntary. If you provide suggestions or ideas, you permit us to use them without restriction or compensation, provided we do not publicly identify you as the source without permission.

11. Third-party services and websites

The Service depends on third-party hosting, database, authentication, network-retrieval, payment, email, domain, security, and infrastructure providers. A report may refer to or retrieve information from a website that we do not control. We are not responsible for third-party content, availability, policies, or conduct.

12. Availability and changes

We may modify, limit, suspend, or discontinue all or part of the Service. We do not promise uninterrupted or error-free operation. Scans may fail or be limited because of website configuration, network conditions, security restrictions, unsupported content, technical limits, maintenance, or third-party outages.

We may update checks, prioritization rules, limits, and report presentation. Existing reports generally retain the observations and rules-version information recorded when generated.

13. Suspension and termination

You may stop using the Service at any time and may delete eligible sites, scans, or your account through available controls or by contacting us.

We may suspend or terminate access if you violate these Terms, create risk or potential legal exposure, fail to pay amounts due, misuse the Service, or if continued operation is impractical. Sections that by their nature should survive termination will survive, including payment obligations, intellectual-property provisions, disclaimers, limitations of liability, indemnity, and dispute terms.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” BOZARTH SOFTWARE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AND UNINTERRUPTED OPERATION.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOZARTH SOFTWARE AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES; OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BOZARTH SOFTWARE FOR SITEBRIEF DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.

These limitations do not apply where prohibited by law and do not limit liability that cannot lawfully be limited.

16. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Bozarth Software and its members, managers, employees, and contractors from third-party claims, damages, losses, and reasonable expenses arising from your unauthorized submission or evaluation of a website, your violation of these Terms or applicable law, or your infringement of another person’s rights.

17. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute not subject to a different procedure required by applicable law will be brought exclusively in the state or federal courts located in or serving El Dorado County, California, and each party consents to personal jurisdiction and venue there.

Nothing in this section waives rights or remedies that applicable consumer law does not permit you to waive.

18. Changes to these Terms

We may update these Terms. We will post the updated version and change the “Last updated” date. If a change is material, we will provide additional notice when reasonably required. Changes apply prospectively from their stated effective date. If required, we will request renewed acceptance.

19. General terms

These Terms, the Privacy Policy, the Refund Policy, and checkout terms form the entire agreement concerning the Service, except for a separate written agreement signed by Bozarth Software. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, financing, reorganization, or sale of assets.
